SERVICE AGREEMENT
1. All information presented by the Golf Fitness
Challenge is for education purposes only. The material is not intended
to be a substitute for medical counseling. The material is intended to
help you make informed decisions about your diet, health and various
exercises for golf. Before adhering to any of the information or
recommendations presented throughout the Golf Fitness Challenge web
site, downloaded material and/or newsletter, please consult with your
own physician or healthcare practitioner. The Golf Fitness Challenge
reserves the right to refuse or cancel membership to any party for any
reason, including certain medical conditions.
2. GENERAL TERMS AND CONDITIONS: You agree to: (a)
maintain all equipment necessary for your access to and use of the Golf
Fitness Challenge; (b) updating your personal information, including
e-mail address.
3. TERM OF SERVICE: Once you have downloaded the material it is yours to keep upon purchase. There are no additional costs associated with this program outside of your initial purchase.
4.CANCELLATION BY YOU.
You may cancel your purchase at any time within a 60 day window of the date of your purchase. Upon doing so, you are entitled to a full refund on your initial purchase price. Cancellation requests should be sent to susan@fitnessforgolf.com.

indicating within the body of the message your intent to cancel.
Be sure to include your first and last name and user name.
Please note that Golf Fitness Challenge will not accept or open
email communications with attachments.
By mail: send a brief letter, including your first
and last name, user name and email address, and mail it to:

6. CHANGES TO SERVICE. Golf Fitness Challenge may
change, modify, add, suspend or discontinue, temporarily or permanently,
any aspect of the Site at any time, including the availability of any
feature, database, or content, with or without notice to you. Golf
Fitness Challenge may also impose limits on certain features and
services or restrict your access to part or all of the Site without
notice to you. You agree that Golf Fitness Challenge shall not be liable
to you or to any third party for any such change, modification,
addition, suspension, discontinuance, limitation or restriction.
7. WAIVER, RELEASE AND LIMITATION OF LIABILITY: You
agree that neither Fitness For Golf, LLC, nor its affiliates,
subsidiaries, officers, directors, employees, agents, consultants or
information providers or suppliers, shall have any liability to you
under any theory of liability or indemnity in connection with your use
of Fitness For Golf, LLC You hereby release and forever waive any and
all claims you may have against Fitness For Golf, LLC, its officers,
directors, employees, agents, consultants, information providers or
suppliers for losses or damages you sustain in connection with your use
of Fitness For Golf, LLC.
8. Notwithstanding the foregoing paragraph, the
total liability of Fitness For Golf, LLC and its officers, directors,
employees, agents, consultants, information providers and suppliers, if
any, for losses or damages shall not exceed the fees paid by you for the
particular information or service provided. All other damages, direct or
indirect, special, incidental, consequential or punitive arising from
any use of the information or other parts of Fitness For Golf, LLC are
hereby excluded even if Fitness
For Golf, LLC or its officers, directors, employees, agents,
consultants, information providers or suppliers have been advised of the
possibility of such damages. Void where prohibited by law.
9. NOTICE: Golf Fitness Challenge may deliver
notice to you under this Agreement by means of electronic mail, a
general notice on Golf Fitness Challenge or by written communication
delivered by first class
